AS STATED IN THE YOTTA TERMS OF USE, ALL OF YOUR ACTIVITY THROUGH THIS SITE INCLUDING YOUR PARTICIPATION IN ANY SWEEPSTAKES IS SUBJECT TO THE TERMS OF USE - INCLUDING MANDATORY ARBITRATION PROVISIONS IN THE TERMS OF USE WHICH REQUIRE YOU TO ARBITRATE ANY CLAIMS AGAINST AS AN INDIVIDUAL AND NOT AS PART OF A CLASS ACTION. These Sweepstakes Rules are incorporated as part of the www.withyotta.com’s Terms of Use and are not meant as a replacement or a new agreement. Defined terms in the Terms of Use shall have the same meaning as used in these Sweepstakes Rules.
In addition, the Site’s Privacy Policy expressly applies, and any information provided by a Participant to Sponsor will be subject to the terms of the Privacy Policy as well as the Terms of Use.
Yotta is an online and mobile application platform which offers Participants the chance to play games for entertainment and enjoyment. Yotta also gives away a virtual currency referred to as YottaCash which can be used to gain sweepstakes entries in the form of "Tickets"' as set out in these Sweepstakes Rules ("Rules"). YottaCash can be used to Participate in Promotional Play for a chance to win further YottaCash which are redeemable for real prizes through the YottaBall sweepstakes game as outlined in section 6 of these Rules.
You can earn YottaCash for USD deposited with Yotta. As of the publishing date of these Yotta Sweepstakes Official Rules Version 1.2, eligible customers earn a 5% Annual Percentage Yield (APY) in YottaCash on their USD balance, awarded on a daily basis. A YottaCash allows an individual to play the Games offered on the App. For example, in Yottaball, 0.05 YottaCash allows a User to get one (1) Ticket and select one set of numbers. A set of numbers consists of five regular numbers and one Yottaball. If an individual has a Ticket but does not select numbers, the individual will be assigned random numbers (five numbers and one Yottaball). As detailed below when the numbers on an individual’s Ticket match the randomly drawn numbers the individual will win YottaCash which can then be redeemed for USD cash. There are also Games offered on the Platform that allow Users the opportunity to use YottaCash to win additional YottaCash.
PARTICIPANTS IN THE SWEEPSTAKES MUST REGISTER AND MAINTAIN AN ACCOUNT WITH YOTTA AND ACCEPT THE TERMS OF USE, WHICH IN TURN INCORPORATE AND APPLY TO THESE RULES. THESE RULES GOVERN AND CONTROL THE SWEEPSTAKES OFFERED BY YOTTA AND ARE CONSIDERED TO BE PART OF THE TERMS OF USE.
These Sweepstakes Rules are to be read in conjunction with the Yotta Terms of Use. Terms which are defined in the Terms of Use have the same meaning in these Sweepstakes Rules.
PLEASE NOTE THAT THESE SWEEPSTAKES RULES INCORPORATE SECTION [11] OF THE TERMS OF USE, WHICH INCLUDE A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND YOTTA THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME.
Sponsor/Promoter
1.1. The sole “Sponsor/Promoter” of the Sweepstakes is Yotta Technologies Inc., 2261 Market Street #4313 San Francisco, CA 94114 (“Yotta”). All sweepstakes are administered by Yotta.
1.2. Apple and Google are not sponsors of, responsible for conducting, or involved with the Sweepstakes in any manner.
Eligibility
2.1. The Yotta Sweepstakes (the “Sweepstakes”) is open only to legal residents of the 50 United States and the District of Columbia (excluding the states of Idaho and Nevada), who are at least eighteen (18) years old at the time of entry or the age of majority in their jurisdiction (whichever occurs later) at the time of entry. Additional rules regarding eligibility apply (e.g., see for example Section 12). PARTICIPATION IS VOID WHERE PROHIBITED BY LAW. Proof of residency and age and identity is required to win cash and other prizes.
2.2. Participants that meet all applicable legal requirements and the requirements imposed by Yotta, including, inter alia, the Sweepstakes Rules and Terms of Use, are herein referred to as “Eligible Participants.”
2.3. The Sweepstakes is subject to all applicable federal, state, provincial, territorial and local laws and regulations. It is the sole responsibility of a Participant to determine whether the Sweepstakes is legal and compliant with all regulations in the jurisdiction in which the Participant is located.
2.4. Participation constitutes the Participant’s full and unconditional agreement to these Sweepstakes Rules and Sponsor’s/Promotor’s decisions, which are final and binding in all matters related to the Sweepstakes.
2.5. Entering the Sweepstakes and winning a prize is contingent upon fulfilling all requirements set forth in these Sweepstakes Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Sweepstakes.
2.6. Eligible participants in the Sweepstakes must register and maintain an account with Yotta and accept the Terms of Use for the chance to win cash and other prizes.
2.7. Employees and directors of Yotta Technologies Inc. and its subsidiaries, divisions, affiliates, and advertising or promotional agencies or individuals involved with the design, production, execution or distribution of the Sweepstakes are prohibited. Former employees are directors (less than 3 years since cessation of their employment) with Yotta and any of their affiliates, subsidiaries, holding companies, advertising agencies, or any other company or individual involved with the design, production, execution or distribution of the Sweepstakes and their immediate family (spouse, parents, siblings and children, whether the relationship is by birth, marriage or adoption) and household members (people who share the same residence at least 3 months of the year) are not eligible to participate.
2.8. The Sweepstakes is open to Participants who are recreational only. If a Participant is, in the Sponsor/Promoter’s best judgment, determined to be professional or non-recreational and is using systemic methods to obtain prizes, Sponsor/Promoter reserves the right to limit entries or exclude the Participant from the Sweepstakes.
2.9. If a Participant is, in the Sponsor’s / Promoter’s best judgment, determined to have participated in unethical behavior, the Sponsor/Promoter reserves the right to limit or exclude the Participant from the Sweepstakes.
3. Timing
3.1. The Sweepstakes as set forth by these Rules, begins on $monthStart/$dayStart/$yearStart at 9PM Eastern Time (“ET”) and ends the sooner of i) $monthEnd/$dayEnd/$yearEnd at 9:00PM ET or ii) $1,500,000 in prizes have been won (the “Sweepstakes Entry Period”). Each day within the Sweepstakes Entry Period there will be a number selection where Tickets earned via YottaCash will have a chance to win a prize for that day. A day starts at 9PM ET and ends the following day at 9PM ET.
4. How to Collect YottaCash For Free
4.1. To participate, you must have an active Customer Account. If you do not have a Customer Account, to can create one free of charge by downloading the Yotta app in the Apple App or Google Play Store or at www.withyotta.com. To enter the Sweepstakes, a participant must sign into their Customer Account.
4.2. Once Participants have accessed their Customer Account, there are [5] ways for an eligible Participant to collect YottaCash:
(a). You can earn YottaCash for USD deposited with Yotta. As of the publishing date of these Yotta Sweepstakes Official Rules Version 1.2, eligible customers earn a 5% Annual Percentage Yield (APY) in YottaCash on their USD balance, awarded on a daily basis. At any time, you can reach out to support@withyotta.com and request a re-assessment of your YottaCash ratios.
(b). Mailing In. Participants can receive free YottaCash by sending a request by Mail. You can receive 0.05 YottaCash by sending a stamped #10 envelope containing one 3”x5” hand-written Request card to the following address: Yotta Technologies Inc. 2261 Market Street #4313 San Francisco, CA 94114. Participants must also adhere to the following process to receive YottaCash by post:
(i) handwrite Participant’s return address on the front on the envelope and the word: “Yotta Sweepstakes Credits;” and
(ii) handwrite all of the following on only one side of the Request Card inserted in the envelope in the following order:
(A). Participant’s full name as shown on their government issued identification;
(B). The email address registered to Participant’s Yotta account;
(C). The username associated with Participant’s Yotta account;
(D). The phone number associated with Participant’s Yotta account;
(E). The return/residential address registered to Participant’s Yotta account; and
(F). The following statement:
“I wish to receive 0.05 YottaCash to participate in the sweepstakes promotions offered by Yotta. By submitting this request, I declare that I have read, understood, and agree to be bound by Yotta’s Terms of Use and Sweepstakes Rules.”
(iii) There is a limit of one request per outer envelope.
(iv) For each request a Participant submits, the Participant will at this time receive 0.05 YottaCash. THE MAXIMUM NUMBER OF REQUESTS PER HOUSEHOLD SHALL BE 1 MAIL IN REQUESTS PER SWEEPSTAKES PERIOD – ALL REQUESTS IN EXCESS OF SHALL BE DEEMED NULL AND VOID, AND SHALL NOT “CARRY OVER” TO ANOTHER PROMOTIONAL PERIOD. The YottaCash awarded via this method will be added to the Eligible Participant’s account subject to account verification and compliance in full with this subsection (d).
(v) NOTE: A Participant must ensure that their handwriting is legible. If the Participant’s hand writing is not legible or otherwise fails to comply with this subsection (d), the entry will be void and the YottaCash will not be credited to the Participant’s account. Limit of one request per envelope. The entry will award 0.05 YottaCash on the next Monday, after the mail in was received (not postmarked). Requests that do not comply with the above will not be acknowledged or returned. The legibility of a Participant’s hand writing shall be determined by Sponsor/Promoter in its sole discretion
(c). Complete specific “behaviors” in the Yotta App as designated by Sponsor. From time to time, Sponsor will designate specific “behaviors” that, when completed during the applicable time period, will reward participants with YottaCash. Eligible “behaviors” will be announced from time to time within the App or via Email, as determined in Sponsor’s sole discretion.
(d). Receive Bonus YottaCash with Purchase of Tokens. Each eligible Participant may purchase Tokens, which are used to play the Games for free. When Eligible Participants purchase Tokens, they may receive YottaCash as a bonus.
(e). Win YottaCash by Winning Sweepstakes Games. Eligible Participants with YottaCash can use their YottaCash to play sweepstakes games for a chance to win additional YottaCash.
4.3. YottaCash cannot be purchased under any circumstances. ANY REQUEST FOR YOTTACASH MUST ONLY BE MADE BY THE ELIGIBLE PARTICIPANT AND MUST BE POSTED FROM THE SAME STATE OR PROVINCE AS THE ELIGIBLE PARTICIPANT’S VERIFIED RESIDENTIAL ADDRESS. Requests made by any other individual or any entity, including but not limited to commercial sweepstakes subscription notification and/or entering services, will be declared invalid and YottaCash will not be credited to the Participant’s account.
4.4. Tampering with the entry process or the operation of the Sweepstakes, including but not limited to the use of any device to automate the YottaCash request/entry process, is prohibited and any requests/entries deemed by Sponsor/Promoter, in its sole discretion, to have been submitted in this manner will be void. In the event a dispute regarding the identity of the individual who actually submitted a request cannot be resolved to Sponsor/Promoter’s satisfaction, the affected request/entry will be deemed ineligible, in the sole discretion of Yotta.
4.5. The amount of YottaCash a Participant is awarded from all sources under Section 4 shall be as reflected in these Rules or on the Platform and may be changed at any time by the Sponsor/Promoter in its sole discretion. The amount of YottaCash a Participant has will be displayed in their Customer Account on the website or mobile application. The amount of YottaCash to be allocated to Participants can be changed at any time by the Sponsor/Promoter in its sole discretion.
4.6. In the event of a dispute as to any registration of a Customer Account, the authorized account holder of the email address used to register the Customer Account will be deemed to be the Eligible Participant. The “authorized account holder” is the natural person assigned the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
4.7. Sponsor/Promoter is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected YottaCash requests or allocations.
4.8. The use of any automated or other system(s) to Participate, to acquire YottaCash, or play the Games is prohibited and will result in disqualification and loss of eligibility to Participate in the Games.
4.9. YottaCash are only valid for 30 days from the date an Eligible Participant last logged into their Customer Account and when they automatically expire.
4.9.1. Inactive Accounts. If an Eligible Participant does not login to their Customer Account within a 30-day period or their account is otherwise deemed inactive in the sole discretion of Yotta, Participant will forfeit any balance of YottaCash and unclaimed prize winnings. Unless Yotta agrees and decides otherwise, YottaCash are only valid for thirty (30) days from the date the Participant last logged on to their Customer Account and will thereafter automatically expire.
4.9.2. YottaCash may also be forfeited if a Participant’s Customer Account is closed or terminated for any reason, including at the Sponsor/Promoter’s discretion.
4.9.3. Use of any automated system to enter is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries all of which will be ineligible to win a prize. In the event of a dispute as to any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder to be awarded the prize. Limit of 500,000 YottaCash per person per day, regardless of method of obtaining a YottaCash
5.0. Using YottaCash to Play the Games
5.1. Eligible Participants may use YottaCash to play the Games on the Site for the chance to win additional YottaCash. Only Games played with YottaCash provide the opportunity to win additional YottaCash. YottaCash accumulated through Game play or via depositing funds may be considered eligible to be entered by Eligible Participants for cash and prizes of monetary value in accordance with these Sweepstakes Rules.
5.2. Within the Games section of the Platform, an Eligible Participant will be able to change their Game mode between playing with Tokens and YottaCash. Once in sweepstakes mode, an Eligible Participant will be able to use YottaCash in the sweepstakes games. The amount of YottaCash required to play each game will be detailed next to the game. The amount of YottaCash an Eligible Participant stands to win will be displayed on the Platform during a game. If an Eligible Participant wins a game the Eligible Participant increases their YottaCash balance by the payout amount and if they lose the amount of YottaCash the Eligible Participant used in the game is not returned.
5.3. YottaCash may be played in the Yottaball sweepstakes game whereby one (1) ticket is entered into the game for every 0.05 YottaCash. Prizes won from the Yottaball game are awarded in YottaCash which can be redeemed 1:1 for USD as outlined in section 6 of these Sweepstakes Rules, subject to maximum and minimum prize redemption amounts stated in Section 6. YottaCash possess no real monetary value and may only be used in the sweepstakes game whereby prizes can be won. All prize redemptions through the sweepstakes game must request a prize redemption to be approved and processed by the Sponsor/Promoter. Approval is subject to an Eligible Participant completing all verifications to confirm eligibility and adherence to all Sweepstakes Rules and Terms of Use of the Platform.
5.4. The use of automated or systematic methods of play to enter or win YottaCash and receive prizes is strictly prohibited. Utilizing methods such as making equal and opposite selections, utilizing multiple accounts and identities, referring oneself to earn additional YottaCash and other collusive methods are not permitted and may result in account closure and forfeiture of YottaCash, in the sole discretion of Yotta.
5.5. Sponsor’s/Promoter’s decisions as to the administration and operation of the Sweepstakes, the game and the amount of winnings are final and binding. Sponsor/Promoter reserves the right to change the prize win rates and payout odds of any of the Sweepstakes games at any time. A Participant can obtain the actual and any amended details of any game by checking the “information” button in any game. It is a Participant’s responsibility to check the prize available on each occasion before they participate. 6.0. PRIZES VIA YOTTABALL SWEEPSTAKES
6.1. Redeemable YottaCash Prizes are only awarded to Eligible Participants via the YottaBall sweepstakes game via the Sponsor. Redeemable Prizes cannot be won via any other method.
6.2. Yotta allows individuals to earn YottaCash via any method in Section 4. YottaCash allows an individual to participate in the YottaBall Sweepstakes and Sweepstakes Games. In the YottaBall Sweepstakes, Participants select one set of numbers per one (1) ticket earned from 0.05 YottaCash. A set of numbers consists of five regular numbers and one YottaBall. If an individual has a Ticket but does not select numbers, the individual will be assigned random numbers (five numbers and one YottaBall). As detailed below when the numbers on an individual’s Ticket match the randomly drawn numbers the individual will win YottaCash that can be redeemed 1:1 for USD.
6.3. The same Eligibility and Sponsor that pertain to these Rules govern the YottaBall Sweepstakes and Sweepstakes Games.
6.4. The YottaBall Sweepstakes and Games can be accessed via the application or at www.withyotta.com.
6.5. The YottaBall Sweepstakes functions as follows:
(a) Six numbers (five regular numbers and one YottaBall) will be randomly selected and revealed every night at 9pm ET during the Sweepstakes Entry Period.
(b) The numbers will be drawn within the Yotta App. As stated below if the numbers on your Ticket match the randomly selected numbers you will receive YottaCash prizes.
(c) Other Yotta Games may be offered on the Platform. Such Games are subject to change without notice.
6.6. The maximum redemption of a prize won by a single Participant during any YottaBall Sweepstakes Period (“Maximum Redemption”) is limited to the value of 5,000 YottaCash redeemable for US $5,000 in New York or Florida. Any requested Redemption in excess of the value of US $5,000 in New York or Florida, will not be paid to the Participant during the period, but must be deferred until the next Sweepstakes Period.
6.7. The minimum redemption of a prize which may be requested by a Participant during any YottaBall Sweepstakes Period (“Minimum Redemption”) shall be 50 YottaCash redeemable for USD $50 prize won via the YottaBall sweepstakes. Any requested redemption less than the Minimum Redemption shall not be permitted via the Platform or paid to the Participant.
6.8. Six numbers (five regular numbers and one Yottaball) will be randomly selected and revealed every night at 9pm ET during the Sweepstakes Entry Period. The numbers will be drawn within the Yotta App. As stated below if the numbers on an Eligible Participant’s Ticket match the randomly selected numbers the Eligible Participant will receive cash prizes.
7. Prizes and Odds
*If the prize does not say “per ticket” then the prize listed will be split equally amongst all individuals at that level. For example, if there are 3 matches with the same number of numbers (including the Yotta Ball) the prize will be equally split amongst those three individuals.
**The grand prize will be paid in 24 monthly installments with each installment equal to $41,666.67 - (assumes there is one winner). If there are multiple winners, the winners will split the $1,000,000 evenly, also in 24 equal monthly installments.
***If there are multiple winners, the winners will split the $100,000 prize evenly, which will be paid to relevant winners over 12 equal monthly installments.
If you do not have a Yotta Account you will not be eligible for a prize. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. All federal, state, and local tax liabilities, as well as any other costs and expenses not specified herein as being awarded are the sole responsibility of the Winner. Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. Please note that prizes for won in Florida and New York are limited to 5,000 YottaCash redeemable for $5,000 USD during any Sweepstakes Period. Prizes won in Florida and New York above $5,000 USD will be deferred until the next Sweepstakes Period.
8.0. Verification.
8.1.1 ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR SPONSOR’S REPRESENTATIVE (IN ANY MANNER IT MAY CHOOSE). SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNER AND OTHER MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE APP SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING SELECTIONS HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY POTENTIAL WINNER NOTIFICATION THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE, IS VOID, AND WILL NOT BE HONORED.
8.2. Potential prize winners must comply with these Sweepstakes Rules and the Terms of Use and winning is contingent upon fulfilling all requirements set by Sponsor in Sponsor’s sole discretion.
8.3. A potential prize winner may be required to sign and return to Sponsor, an affidavit/declaration of eligibility, and liability/publicity release (except where prohibited) in-order to claim his/her prize (if applicable).
8.4. If the potential winner cannot be contacted or fails to properly execute and return the affidavit/declaration of eligibility and liability/publicity release within the required time period (if applicable), fails to comply with these Sweepstakes Rules or if the prize or prize notification is 50 returned as undeliverable, that potential winner forfeits the prize.
9.0. Notice and Confirmation of Potential Winners
9.1. Potential winner will be notified via the App or using the email address / phone number provided with the entry or on file with the Sponsor. Failure by potential Sweepstakes winner to respond to the initial verification within ten (10) days of notification will result in disqualification. Potential Sweepstakes winner may be required to complete and return an Affidavit of Eligibility, provide identification, Release of Liability and Publicity Release (where permitted by law) (collectively, the “Affidavit”) by the date specified by Sponsor, or an alternate potential Sweepstakes winner may be selected. In the event: (a) potential Sweepstakes winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential Sweepstakes winner notification or Affidavit is returned as undeliverable; (b) potential Sweepstakes winner declines or cannot accept, receive or use the prize for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods; (d) potential Sweepstakes winner is found to be ineligible to enter the Sweepstakes or receive the prize; (e) potential Sweepstakes winner cannot or does not comply with the Official Rules; or (f) potential Sweepstakes winner fails to fulfill the Affidavit-related obligations, the potential Sweepstakes winner shall be disqualified. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of alternate potential Sweepstakes winner, if any.
9.2. Participants must successfully complete a Know-Your-Customer (KYC) Verification process provided by the Sponsor/Promoter to validate eligibility to participate before redeeming any prize. This may include, but is not limited to, providing proof of a valid government-issued photo identification, biometric facial scan recognition, proof of address, and validation of SSN.
9.3. Potential prize winners must comply with these Sweepstakes Rules, and winning is contingent upon fulfilling all requirements.
9.4. A potential prize winner may be required to sign and return to Sponsor/Promoter, an affidavit/declaration of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize (if applicable).
9.5. If a potential winner cannot be contacted, fails to properly execute and return any required affidavit/declaration of eligibility and liability/publicity release within the required time period (if applicable), fails to comply with these Sweepstakes Rules, or if the prize or prize notification is returned as undeliverable, that potential winner forfeits the prize.
10. Entry Conditions and Release
10.1. Each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor which is binding and final in all matters relating to this Sweepstakes; (b) defend, indemnify, release and hold harmless the Sponsor and their respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry.
11. Sweepstakes Prizes
11.1. Prizes are only awarded to Eligible Participants via the Sweepstakes games via the Sponsor. Prizes cannot be won via any other method. Unless otherwise stated or required by Sponsor/Promoter, Tickets acquired by an Eligible Participant by any method available under Section 4 must first be played through the Yottaball Sweepstakes at least once before any prize can be claimed. If an Eligible Participant wishes to claim any Prize, Eligible Participant may do so by clicking on the “Claim” button on the site or app menu option.
11.2. To be eligible for a Sweepstakes Prize or a Sweepstakes Prize Redemption:
(a). A PARTICIPANT MUST BE A LEGAL RESIDENT OF AND LOCATED IN THE STATES OF THE UNITED STATES (EXCLUDING IDAHO AND NEVADA); and
(b). THE PARTICIPANT’S DETAILS MUST MATCH THOSE OF THE PARTICIPANT’S ACCOUNT.
11.3. The maximum redemption of a prize won by a single Eligible Participant during any YottaBall Sweepstakes Period (“Maximum Redemption”) is limited to the value of US $5,000 for Eligible Participants located in New York or Florida per Sweepstakes Period. Any requested Redemption in excess of the value of US $5,000 in New York or Florida will be reduced to $5,000 and will not be paid to the Eligible Participant during the period, but must be deferred until the next Sweepstakes Period.
11.4. The minimum redemption of a prize which may be requested by a Participant during any YottaBall Sweepstakes Period (“Minimum Redemption”) shall be a $50 prize won via the YottaBall sweepstakes. Any requested redemption less than the Minimum Redemption shall not be permitted via the Platform or paid to the Participant.
11.5. Participant shall solely be responsible for any federal, state or local taxes or fees associated with any prize redemption. Sponsor will provide Participants with necessary tax forms if requested by Participant. Participants are responsible for remittance of all applicable taxes and fees associated with prize receipt and/or redemption and should consult their accounting or tax experts for any assistance.
11.6. Tickets are non-transferable and no substitution will be made except as provided herein at the Sponsor’s/Promoter’s sole discretion. Sponsor/Promoter reserves the right to substitute the listed prize of equal or greater value for any reason owing to circumstances outside Sponsor’s/Promoter’s reasonable control.
11.7. Prize winners must request the release of their Prize solely through the Platform.
11.8. We make our best efforts to process requests within the quoted amount of time but do not guarantee processing times for prizes.
11.9. We will only process one Prize redemption request per Customer Account in any 5-day period.
11.9.1. You acknowledge and agree that in some circumstances it may take up to 30 days to process the payment of any redeemed Prizes to you.
11.9.2. Redemption of Prizes may experience delays due to our identity verification process. Prizes of $600 or more may require a longer processing time than usual due to security and fraud checks and may also be allocated in more than one equivalent lump sum. This may add up to 7 days to the normal processing time, but is dependent on the circumstances of each individual case.
11.9.3. You acknowledge and agree that we may in our sole discretion, from time to time, appoint one or more Payment Administration Agent to accept payments (including merchant facilities) from Players on our behalf.
11.9.4. A Payment Administration Agent will have the same rights, powers and privileges that we have under these Terms and Conditions and will be entitled to exercise or enforce their rights, powers and privileges as our agent or in their own name. In no event shall we be liable to any Player for any loss, damage or liability resulting from the Payment Administration Agent’s negligence and/or acts beyond the authority given by Yotta Technologies Inc.
11.9.5. YottaCash may be forfeited if a Customer Account is deactivated due to a violation of our Terms of Use or for any reason, or at our discretion. See Terms of Use.
11.9.6. If we mistakenly credit your Customer Account from time to time with Prizes that do not belong to you, whether due to a technical error, human error or otherwise, the amount will remain property of Yotta Technologies Inc. and will be deducted from your Customer Account. If you have been issued a Prize that does not belong to you, the value of the mistakenly issued Prize will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to us. In the event of an incorrect crediting, you are obliged to notify Customer Support by using the “Contact” link on the Platform or by emailing support@withyotta.com. Yotta at all times reserves the right to deduct YottaCash from your Account or otherwise charge or adjust your account to correct errors.
11.9.7. It is the responsibility of the Participant to retain copies of transaction records and these Sweepstakes Rules as updated from time to time.
12. Entry Conditions and Release
12.1. By Participating, each Participant agrees to:
(a) comply and be bound by:
(i). the Terms of Use, including without limitation, any ethical provisions as set forth in the Terms of Use;
(ii). comply with and be bound by these Sweepstakes Rules, the Terms; and Conditions; and
(iii). the decisions of the Sponsor/Promoter which are binding and final;
(b) release and hold harmless the Sponsor/Promoter and its parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a Participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prizes (including any travel or activity related thereto) and/or the broadcast, and exploitation or use of entry; and
(c) indemnify, defend and hold harmless the Sponsor/Promoter from and against any and all claims, expenses, and liabilities (including reasonable attorneys/legal fees) arising out of or relating to a Participant’s participation in the Sweepstakes and/or Participant’s acceptance, use or misuse of prizes.
13. Winner’s List
13.1. Except where prohibited, participation in the Sweepstakes constitutes each Participant’s consent to Sponsor’s/Promoter’s and its agents’ use of Participant’s name, likeness, photograph, voice, opinions and/or hometown and state/province/territory for promotional purposes in any media, worldwide, without further payment, notice or consideration.
13.2. For a list of winners during a Sweepstakes Period within 60 days from the date of request, send a request in writing by mail, specify the Month and Year requested (one Sweepstakes Period per request), and enclose a handwritten, self-addressed, stamped envelope to:

Only one (1) date may be requested per date. Requests seeking a Winners’ List for more than one date will be deemed to request the first date within the request.
14. Publicity
14.1. Except where prohibited or restricted by law, participation in the Sweepstakes constitutes Participant’s consent to Sponsor/Promoter’s and its agents’ use of Participant’s name, likeness photograph, voice, opinions and/or hometown and state/province/territory for promotional purposes in any media, worldwide, without further payment, notice or consideration, winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of their designees to use and/or publish winner’s entry, name, city and state of residence, and/or statements made by winner regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.
15. General Conditions
15.1. Sponsor/Promoter reserves the right to cancel, suspend and/or modify the Sweepstakes or these Sweepstakes Rules, or any part of the Sweepstakes or these Sweepstakes Rules, with immediate effect owing to circumstances outside its reasonable control and only where circumstances make it unavoidable if any fraud, technical failures or any other factor beyond Sponsor’s/Promoter’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor/Promoter in its sole discretion.
15.2. Sponsor/Promoter reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Sweepstakes Rules or any other promotion or in an unsportsmanlike or disruptive manner.
15.3. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor/Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s/Promoter’s failure to enforce any term of these Sweepstakes Rules shall not constitute a waiver of that provision.
15.4. In all other cases, the Sponsor/Promoter reserves the right to cancel, suspend and/or modify the Sweepstakes. Any notice regarding cancellation, suspension and/or modification will be posted on Yotta on the Platform or at www.withyotta.com.
15.5. Whenever we amend these Sweepstakes Rules in a way that would limit your current rights or which may be to your detriment, we will notify you upon your next visit to the Platform and you will be required to re-confirm your acceptance prior to participating in any Promotional Play. If you do not agree to the amended Sweepstakes Rules, you may not participate in any Promotional Play.
15.6. In the event of modifying the Sweepstakes, a Participant’s continued enrollment and/or participation in the Sweepstakes constitutes acceptance of the modified terms.
15.7. If for any reason an Eligible Participant’s Tickets or winning play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is replacement by Sponsor/Promotor of an equivalent amount of Tickets.
Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Sweepstakes or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes, or with any Website promoting the Sweepstakes; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple email addresses or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Sweepstakes, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the prize from all eligible entries received as of the termination date.
16. Limitations of Liability
16.1. The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error in the administration of the Sweepstakes or the processing of registrations; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s registration is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of each prize will be awarded.
17. Disputes
17.1. You and Yotta agree that any past, pending, or future dispute, claim or controversy arising out of or relating to any purchase or transaction by You, your access to or use of any Platform or the Service, or to this Agreement, the Terms of Use, the Sweepstakes Rules or Privacy Policy (including without limitation any dispute concerning the breach, enforcement, construction, validity, interpretation, enforceability, or arbitrability of this Agreement or the Terms of Use) (a “Dispute”), shall be determined by arbitration, including claims that arose before acceptance of any version of this Agreement, except that you and Yotta are NOT required to arbitrate any Dispute in which either party seeks equitable and other relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents. In addition, in the event of any Dispute concerning or relating to this Agreement — including the scope, validity, enforceability, or severability of this Agreement or its provisions, as well as the arbitrability of any claims—you and Yotta agree and delegate to the arbitrator the exclusive jurisdiction to rule on his or her own jurisdiction over the Dispute, including any objections with respect to the scope, validity, enforceability, or severability of this Agreement or its provisions, as well as the arbitrability of any claims or counterclaims presented as part of the Dispute.
17.2. For additional information pertaining to arbitration of disputes, including the procedure for initiating arbitration, the location of arbitration and applicable rules, please review Section 11 of the terms of Use.
18. Other
18.1. To ensure fairness and the integrity of the promotion to all Participants, the Sponsor/Promoter will respond to questions via support@withyotta.com and may post updates/communications on its social media pages.
18.2. Any Participant posting or seen to be posting comments on Sponsor’s/Promoter’s social media pages, Facebook page or elsewhere during the promotion that are considered bullying, spiteful or upsetting to other Participants, players and fans of Yotta or directly aimed to disparage the Sponsor/Promoter, will have their comments removed, and will be disqualified from the Sweepstakes and subject to termination of their Account. The Sponsor/Promoter reserves the right to alert social media providers. Facebook to any such behavior and the Participant may have his/her relevant social media account frozen pending investigation.
19. Participants’ Personal Information
19.1. Information collected from Participants is subject to the Sponsor’s/Promoter’s Privacy Policy which is available on the Platform and at www.withyotta.com.
20. Extended Meanings; Currency; Force Majure
20.1. Unless otherwise specified in these Sweepstakes Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. Sponsor is not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.
